A woman, Hajiya Uzaifa Garba, has dragged her husband to Sharia Court for allegedly rejecting his son after five months of their marriage in Kaduna.
Hajiya Uzaifa Garba, dragged her husband, Garba Ahmad before Tudun Wada Sharia Court, presided over by Judge Nuhu Falalu, to pray the court for the husband to accept her newborn baby boy as his biological child.
Speaking to our correspondent after the seating, a leading Counsel to the defendant, Barrister Auwal A. Mu’Allimu, of No.2 Court Road Kano, said his application for an extension of date to enable him gather enough time to study the fact of the matter was granted by the Judge Nuhu Falalu.
“I appeared for the first time today after taking over from another lawyer; so, I need time to study fact of the matter, to enable me prepare; so, I applied for extension of date, and the honorable court granted my application,” he said.
Barr. Mu’Allimu said, Uzaifah Garba took Yusuf Ahmad to court over paternity of a son after five months of marriage.
According to him, the wife delivered the child on 21st October, 2016, at Fomwan Hospital in Badarawa, Kaduna state.
The Defendant had contested that the period of marriage does not march with the gestation period to warrant him to accept the product of the marriage.
The Sharia Court, which sat on the 16th January, 2017, for the 3rd time, has adjourned the case to 22nd February, 2017.
Appeared with the leading Counsel to the Defendant were Umar Suleiman & Jalul Bahamas Ahmed Yusuf, while Barr MB Al-Hassan, who represents the Plaintiff, Uzaifa, could not be reached for comment.
